Accident Waiver and Release of Liability Agreement
Acknowledgements:
The signer makes the following acknowledgments on behalf of himself/herself and/or on behalf of the Child under age 18:
I understand the demands of axe throwing activities at Crazy Axe relative to my and/or minor’s skill level and health condition.
I understand the types of injuries that may occur because of activities at a Crazy Axe facility as well as the potential impacts of these injury risks on my and/or the minor’s well-being, lifestyle, and potential future careers. I acknowledge that this activity may involve a test of a person’s physical and mental limits and carries with it the potential for death, severe injury, and property loss.
I acknowledge that Crazy Axe and/or its directors, officers, employees, volunteers, representatives, and agents are not responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf.
I understand that my and/or the minor’s participation, spectating, or involvement in any form in any activity at a Crazy Axe facility is voluntary in nature.
Consent to Receive Medical Treatment:
I hereby consent for me and/or the minor to receive medical treatment that may be deemed advisable in the event of injury, accident, and/or illness during my and/or the minor’s time on the premises of a Crazy Axe facility.
I give Crazy Axe the authority, in its discretion, to secure emergency medical care and/or transportation to a medical facility on my and/or the Child’s behalf. If such medical care and transportation is needed, I agree to assume all costs of such care and transportation.
Media Release.
I understand that while participating in this activity, I and/or the minor may be photographed. and agree to allow my and/or the minor’s photo, video, or film likeness to be used for any legitimate purpose including but are not limited to, the following: marketing brochures, ads, videos, websites, social media, or other media outlets.
I, on behalf of myself and/or the minor, waive all rights to any claims for payment or royalties. I, on behalf of myself and/or the minor, further waive all rights to inspect or approve any photos, videos, or film likenesses taken of me and/or the minor on the Crazy Axe premises and used for a legitimate purpose.
Consent to Crazy Axe Facility Rules:
By signing this document, I am agreeing to act in accordance to the rules of the Crazy Axe facility and/or ensure that the minor is acting in accordance with the rules of the Crazy Axe facility.
I agree to obey all rules and/or agree to ensure the Child obeys all rules and posted signs and I will alert the staff to any rule violations or dangerous behavior I witness at the Crazy Axe facility.
I acknowledge that Crazy Axe has the authority to end my and/or the minor’s participation without a refund if, in the discretion of Crazy Axe, I or the minor presents a danger to themselves and/or others or fails to follow rules or procedures.
I will inform Crazy Axe of any injury, no matter how minor, which I and/or the minor incurs at the facility prior to leaving the Crazy Axe facility.
Assumption of the Risk:
I hereby assume the risks of participating and/or spectating and/or allowing the minor to participate and/or spectate in any and all activities associated with axe throwing and/or related activities at any Crazy Axe facility, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the person or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. Inherent risks of being involved in axe throwing and related activities includes, by way of example: general facility risks, human error risks, and axe throwing risks, as such terms are described in the definition section of this Agreement.
Waiver, Release, Discharge, and Promise not to sue:
In consideration of the privilege of participating in activities and being on the Crazy Axe premises, I, on behalf of myself and/or the Child, my spouse, my heirs, any and all personal representatives, assigns, or others making a claim on my behalf, do hereby waive, release, discharge, and promise not to sue Crazy Axe and/or its directors, officers, employees, volunteers, representatives, as well as the activity holders, sponsors, and/or property owners from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my and/or the Child’s death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me and/or the Child including my and/or the Child’s traveling to and from activities at a Crazy Axe facility.
Severability:
If any term or provision of this Agreement is found by a court of competent jurisdiction to be invalid, illegal, or otherwise unenforceable, the same shall not affect the other terms or provisions hereof or the whole of this Agreement, but such term or provision shall be deemed modified to the extent necessary in the court’s opinion to render such term or provision enforceable, and the rights and obligations of the parties shall be construed and enforced accordingly, preserving to the fullest permissible extent the intent and agreements of the parties set forth.
I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS THAT MIGHT BELONG TO ME AND/OR THE CHILD AND THAT AXE THROWING AND RELATED ACTIVITIES INVOLVE THE RISK OF SERIOUS INJURY AND/OR DEATH. IF SIGNING ON BEHALF OF THE CHILD, BY SIGNING BELOW I REPRESENT AND WARRANT THAT I AM THE PARENT, LEGAL GUARDIAN, AND/OR POWER OF ATTORNEY OF THE CHILD AND HAVE THE AUTHORITY TO EXECUTE THIS AGREEMENT ON HIS/HER BEHALF AND TO ACT ON HIS/HER BEHALF.
Throwers between the ages of 8-17 must be signed for by a person of 18 years or older.
